Introduction
1.1 Welcome to ALFREDO CERVANTES PHOTOGRAPHY. These terms and conditions govern the use of my photography services, including boudoir sessions, family, portrait, graduation, and any other photography services I offer. By booking a session with me, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, please refrain from using my services.
Booking and Payment
2.1. Booking Process: To book a photography session, please contact me through my designated communication channels or website. A session is considered booked only when you receive a confirmation from me and you have paid your 50% deposit. I do not hold slots without a deposit.
2.2. Pricing: My photography session prices are outlined on my website or provided to you upon request. Prices are subject to change without prior notice, but if you have already booked a session, the price at the time of booking will apply.
2.3. Payment: The remaining payment for the photography session is due after our session, unless otherwise agreed upon. I accept Zelle, Apple Pay or Cash, and no session will be confirmed until the 50% deposit payment is received.
2.4. Cancellation and Rescheduling: If you need to cancel or reschedule a session, please notify me as soon as possible. Refunds for cancellations will be subjected to a 50% charge of the selected package. (The 50% deposit).
Intellectual Property
3.1. Copyright: All photographs taken during the photography session are the property of ALFREDO CERVANTES PHOTOGRAPHY and protected by copyright laws. I retain all rights to the photographs.
3.2. Usage Rights: Upon receipt of full payment, you will receive usage rights to the photographs for personal, non-commercial purposes. You may not use the photographs for commercial purposes without my express written consent.
3.3. Modifications: You may not edit or modify the photographs without my permission. Any alterations to the photographs must be approved by ALFREDO CERVANTES PHOTOGRAPHY.
Client Responsibilities
4.1. Cooperation: You agree to cooperate during the photography session to ensure the best possible outcome. This includes following my instructions and respecting the session’s timeline.
4.2. Model Release: By booking a session, you grant me permission to use your photographs for promotional purposes, including but not limited to our website, social media, and marketing materials.
Photographer’s Responsibilities
5.1. Quality of Services: I will use my best effort to deliver high-quality photographs that meet your expectations, but I cannot guarantee specific results.
5.2. Delivery Timeline: I will provide you with an estimated timeline for delivering the final photographs. However, delays may occur due to unforeseen circumstances, and I will keep you informed if any changes arise.
Privacy and Data Protection
6.1. Personal Information: I will collect and use your personal information in accordance with our Privacy Policy, available on our website.
6.2. Image Storage: I will store your images securely for a limited time. Please ensure you keep a backup of the photographs as I am not responsible for any loss or damage.
Liability and Indemnification
7.1. Limitation of Liability: ALFREDO CERVANTES PHOTOGRAPHY shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use of my services or the photographs.
7.2. Indemnification: You agree to indemnify and hold ALFREDO CERVANTES PHOTOGRAPHY harmless from any claims, damages, or expenses arising out of your use of our services or any breach of these terms.
Modifications to the Terms and Conditions
I reserve the right to update or modify these terms and conditions from time to time. Any changes will be effective immediately upon posting on my website. Your continued use of our services after such changes constitutes acceptance of the modified terms.
Entire Agreement
These terms and conditions constitute the entire agreement between ALFREDO CERVANTES PHOTOGRAPHY and you concerning the use of my services, supersedes all prior agreements, and may not be amended except in writing.
